1. Acceptance of Terms

By installing, accessing, or using BundleBirds ("the App," "our Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

These Terms apply to all users of the App, including merchants, store administrators, and any other users with access to the App.

2. Description of Service

BundleBirds is a Shopify application that enables merchants to create and manage product bundles on their online stores. The App provides:

  • 12 different bundle types (Fixed, Custom, Volume, BXGY, Mix & Match, Freebie, Spend More, Subscription, FBT, Upsell, Mystery, Tiered Fixed)
  • Storefront widgets and displays
  • Cart drawer functionality
  • Product search and filtering
  • Analytics and reporting
  • Customization options

3. Account and Registration

To use BundleBirds, you must have a valid Shopify store account. By installing the App, you authorize us to access your Shopify store data as described in our Privacy Policy.

You are responsible for:

  • Maintaining the security of your Shopify account
  • All activities that occur under your account
  • Ensuring your use complies with Shopify's Terms of Service

4. Subscription Plans and Billing

4.1 Pricing

BundleBirds offers the following subscription plans:

  • Free: $0/month - Limited features
  • Starter: $12/month or $120/year
  • Growth: $29/month or $290/year
  • Professional: $79/month or $790/year
  • Enterprise: $199/month or $1,990/year

4.2 Billing

All billing is processed through Shopify's billing system. Charges will appear on your Shopify invoice. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees.

4.3 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades are prorated for the remaining billing period. Downgrades take effect at the next billing cycle.

4.4 Free Trial & Refunds

All paid plans include a 14-day free trial. No credit card is required during the trial period. You can cancel anytime during the trial without being charged.

After the trial period ends and you are charged, all sales are final and non-refundable. We encourage you to fully evaluate the app during your free trial to ensure it meets your needs before committing to a paid subscription.

5. Usage Limits

Each subscription plan has usage limits including:

  • Number of active bundles
  • Monthly orders processed through bundles
  • Number of products in bundles
  • API call limits (where applicable)

Exceeding these limits may result in service restrictions or a prompt to upgrade your plan. We will notify you before taking any action.

6. Acceptable Use

You agree NOT to use BundleBirds to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with other users' use of the service
  • Create misleading or deceptive bundle offers
  • Circumvent usage limits or billing
  • Resell or redistribute the service without authorization

7. Intellectual Property

BundleBirds and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your store data, products, and content. By using the App, you grant us a limited license to access and process this data solely to provide our services.

8. Third-Party Services

BundleBirds integrates with Shopify and may interact with other third-party services. We are not responsible for the availability, content, or practices of third-party services.

Your use of third-party services is governed by their respective terms and policies.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

  • Perform maintenance with reasonable notice
  • Experience temporary outages due to technical issues
  • Modify or discontinue features with 30 days' notice

For Enterprise customers, specific SLA terms are outlined in your service agreement.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • BundleBirds is provided "AS IS" without warranties of any kind
  • We do not guarantee specific results from using the App
  • We are not liable for lost profits, data, or indirect damages
  • Our total liability is limited to the amount paid in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless BundleBirds, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your store's products, services, or content

12. Termination

Either party may terminate this agreement at any time:

  • By you: Uninstall the App from your Shopify store
  • By us: With 30 days' notice, or immediately for Terms violations

Upon termination:

  • Your access to the App will be revoked
  • Bundle displays will be removed from your storefront
  • Your data will be handled according to our Privacy Policy
  • No refunds for any billing periods (all sales are final after trial)

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through:

  1. Informal Resolution: Contact us first at support@bundlebirds.com
  2. Mediation: If informal resolution fails, we agree to attempt mediation
  3. Arbitration: Binding arbitration in accordance with applicable rules

You agree to waive the right to participate in class action lawsuits.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which BundleBirds operates, without regard to conflict of law principles.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via:

  • Email notification to your Shopify store email
  • In-app notification
  • Update to the "Last updated" date

Continued use after changes constitutes acceptance. If you disagree with changes, you must uninstall the App.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BundleBirds regarding the App.
